Five Clear Steps

How the Investment
Process Works

A coordinated process from your first review to a funded investment and ongoing servicing—with experienced professionals supporting each stage.

  1. You review the opportunity

    Review the Loan Opportunity

You receive a loan package outlining the property, borrower, requested financing, proposed terms, collateral, and repayment strategy. This allows you to evaluate each opportunity individually and determine whether it meets your investment objectives.

  2. Independent review supports your decision

Complete Due Diligence and Approve the Terms

Stone Oak coordinates underwriting and independent third-party review, including property appraisals and legal review. Experienced real estate attorneys prepare the loan and closing documents.

Before funding, your investment amount, whole-loan purchase or syndication terms, applicable fees, ownership or participation rights, and any future funding obligations are documented in the transaction agreements. For a syndicated loan, these documents also establish investor allocations, payment priorities and decision rights.

  3. Your funds go directly to escrow

    Fund Directly Through Independent Escrow

You wire your agreed loan capital directly to the designated title company or closing attorney’s escrow account for that transaction. For a syndicated loan, each investor wires their documented allocation and funds are tracked by investor.

Your loan funding does not pass through Stone Oak’s operating accounts. Written escrow instructions establish the conditions for releasing funds, the closing requirements, and the treatment of undisbursed funds if the transaction does not close.

  4. Your rights are established at closing

Close the Loan & Establish Your Investment

Once the funding and closing conditions are satisfied, escrow releases funds under the approved instructions. Your investment follows the structure you reviewed and approved.

    Whole-loan investment

Where permitted, the loan initially closes in the name of Stone Oak Capital Advisory LLC. Through the agreed closing and transfer process, the entire loan—including the promissory note and related mortgage or deed of trust—is assigned to you or your designated entity. Following assignment, you own the loan and its associated security rights under the executed documents.

    Syndicated investment

Multiple investors fund the same loan under the agreed syndication structure. Each investor receives the ownership or participation interest specified in the transaction agreements. Those documents identify the lender of record and establish collateral arrangements, each investor’s rights, payment allocations and decision-making authority.

  5. Professional administration after closing

    Set Up Third-Party Loan Servicing

A qualified third-party servicing company administers the loan, processes borrower payments, maintains records and provides reporting under the servicing agreement.

    Whole-loan investment

You select your qualified servicing provider. Stone Oak can recommend providers, and you remain free to select your own.

    Syndicated investment

Servicing is coordinated for the investor group. The transaction documents define how the qualified servicer is selected or approved, with reporting and investor distributions based on actual collections and the agreed payment allocations.

    For either structure

Stone Oak can recommend servicing providers. Payments are administered and remitted according to the loan, investor and servicing agreements.

Professional Loan Administration

Third-party loan servicing.

A qualified third-party servicer administers the loan, processes payments, maintains records and provides reporting. Whole-loan investors select their provider; syndicated loans use a servicer selected or approved under the transaction agreements. Stone Oak can recommend providers for either structure.

Third-Party Legal Review & Closing Documents

Experienced real estate attorneys.

Experienced real estate attorneys provide third-party legal review and prepare the loan and closing documents, including the promissory note, mortgage or deed of trust, applicable guaranties, escrow instructions and assignment documents.

Frequently Asked Questions

A few things
you may be wondering.

Can I invest individually or alongside other investors?

Both structures are available, depending on the transaction. A single investor or its designated entity may fund and acquire the entire loan. Alternatively, multiple investors may fund the same loan through a documented syndication, with each investor’s interest and rights defined in the transaction agreements.

What will I own?

With a whole-loan purchase, you or your designated entity acquires the entire loan and its associated security rights through the documented assignment. In a syndicated investment, your interest may be structured as a participation, assignment or entity interest. The transaction documents specify what you acquire, the collateral arrangements, payment rights and decision-making authority. A syndication does not automatically give every investor direct ownership of the entire note or a separate mortgage assignment.

Does an inquiry commit me to fund a loan?

No. An introductory inquiry is nonbinding. You review each loan opportunity, complete due diligence and approve the terms before entering into a documented funding commitment. There is no automatic commitment to future loans.

Where do I send my funds?

You wire the agreed loan capital directly to the title company or closing attorney’s designated escrow account for that transaction. Your loan funding does not pass through Stone Oak’s operating accounts. Confirm wiring instructions directly with the escrow provider using a previously verified phone number.

What happens if the transaction does not close?

Written escrow instructions establish the closing conditions, release requirements, and treatment of undisbursed funds. Review the cancellation and return provisions, including applicable deadlines, before funding.

How does funding work with multiple investors?

Each investor approves a specific investment amount and wires directly to the designated independent escrow account. The closing is subject to the required capital and other closing conditions. Written escrow instructions govern the release and treatment of undisbursed funds if the transaction does not close.

Can I choose my own loan servicer?

For a whole-loan investment, you choose a qualified third-party servicer; Stone Oak can recommend providers, or you can select your own. For a syndicated loan, the transaction documents define the selection or approval of the servicer for the investor group. Reporting and payments follow the loan, investor and servicing agreements.

Who handles underwriting and legal documents?

Stone Oak coordinates underwriting and independent professional review. Qualified third parties provide unbiased underwriting and property appraisals. Experienced real estate attorneys provide third-party legal review and prepare the loan and closing documents. Each professional’s engagement defines the scope and parties represented.

How do I get started?

Share your preferred loan size, property types, markets and relevant experience through the inquiry form. We can discuss your criteria and the transaction review process. Each transaction is subject to investor approval, satisfactory due diligence, eligibility, final documentation and closing conditions.

Are principal or interest payments guaranteed?

No. Loan investments involve risk, including possible loss of principal. Borrower default, payment delays, declining collateral values and enforcement costs may affect repayment. Independent escrow, underwriting, legal review and servicing do not guarantee investment performance.
